AMAZING **Canadian Government
sells USED DTV Cards
Yes the Canadian Government has been selling DTV Access cards to the Canadian public or Satellite Dealers. The recent price was 14 cards for $2001 dollars or a net of $143.00 each.
Normally these DTV Access Cards are illegal (or said to be) in Canada and people have been convicted in court for selling these. But the Government does it with impunity and in the above case sold them to a person who war recently convicted under the RC Act so its pretty obvious that they would be used for piracy. Yet the government does not care and did no due diligence to determine who they were selling these to. There was no override or contract that said they had to be sold in the USA, nothing at all. Yet the government had recently assigned a VERY LARGE FINE to this same person (the buyer) for the exact same thing.
This fact was pointed out to a judge in a Montreal court because the law is supposed to be applied equally according to our Charter. It says:
Equality Rights
15.(1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, color, religion, sex, age or mental or physical disability.
(2) Subsection (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, color religion, sex, age or mental or physical disability.

But the Judge who received the plea arguing that this was "fresh evidence" and that had it been known at the time of his trial, would have potentially changed the outcome, especially in the amount of the fine for the very least does not agree. In his view its LEGAL for the government to do this even if its ILLEGAL for you and I.
In fact I really believe that the charges against him should be dropped seeing the governmnet who fined him actually made a profit from selling these itself, which is totally unfair and unequitable. If a citizen is not allowed to sell these cards then neither should the Government be. There was nothing special involved, simply the almighty buck and the desire of the government to make a PROFIT. But it's printed right on the card that it belongs to NDS and not the holder so I can only assume that they have sold stolen property as well. Why did they not simply give them back to DTV if they feel that this ownership should be upheld.
One of two things is happening here. Either our government is getting involved in selling access cards and doing illegal acts for profit (the same acts they fine citizens for) or its simply NOT illegal to sell these cards and make a profit as the law says. But we should know which it is because now, according to this ruling, it would seem that people can sell these cards without a problem. Anyone can open up to sell them and turn a profit on this ordinary item of commerce. Some of us have done this in the past but we have been subject to Government RAIDS with Search and Seazure taking place and the RCMP seizing thousand and in some cases millions of dollars worth of product that the government sells freely and with impunity. HOW CAN THIS BE???
If we look to the courts for an answer we will find that some courts have said its illegal while other courts say its perfectly legal. The law book says its legal so long as they are NOT lawfully authorized in Canada, which they are not. The government does it all the time and are certainly not a good example to follow. And even the courts are all mixed up about it.
But I can assure you that people who have paid fines in the order of $50,000.00 for selling a few of these and then see that the Government (who just fined them) is doing it themselves only a week or two later, are NOT happy campers. Nor would you or anyone else in this situation be. How casn anyone be happy at getting fined $50,000.00 for doing what the Government does without penalty of any kind. And how can this be fair under our Charter of Rights and Freedoms when the GOVERNMENT CAN DO SOMETHING WITH IMPUNITY THAT IS SAID TO B E A CRIME.
I do have a simple question however. " WHY is it so complex to get an understanding of whether its legal or illegal to sell a lousy ACCESS CARD for a DTV satellite system in Canada? Can ANYBODY answer this correctly?
